Legal note: Malaysian law does not permit a business to exclude all liability by disclaimer. Under the Consumer Protection Act 1999, certain guarantees to consumers cannot be excluded, and unfair contract terms may be unenforceable. This Legal Disclaimer ("Disclaimer") is a supplementary document to the Che Wan Travel & Tour Sdn. Bhd.™ Service Agreement ("Agreement"). By engaging with Che Wan Travel & Tour Sdn. Bhd.™ (hereinafter referred to as "the Company"), you acknowledge that you have read, understood, and agreed to the terms, conditions, and notices outlined herein. This Disclaimer governs your use of the Company's services, including but not limited to:

Group Flight Ticket Booking Services (for travel agencies and individuals);
Room, House, and Apartment Rentals;
Event Management Services, including MICE (Meetings, Incentives, Conferences, and Exhibitions);
Tour Packages and E-Ticket Sales for Theme Parks and Other Attractions;
Transportation and Other Related Travel Services.

Liability & Reliability

The Company endeavors to provide accurate, up-to-date, and reliable information regarding its services. However, due to the dynamic nature of the travel industry, errors or omissions may occur despite reasonable efforts. Che Wan Travel & Tour Sdn. Bhd., its authorized affiliates, and contractors disclaim responsibility for inaccuracies or changes in the information provided, except to the extent such information amounts to a misleading or deceptive representation under the Consumer Protection Act 1999. All information is subject to change without prior notice.

The Company acts solely as a Booking Agent or Travel Agent, licensed with the Ministry of Tourism, Arts and Culture Malaysia (MOTAC) under the Tourism Industry Act 1992, for airlines, hotels, tour operators, and other service providers ("Vendors" or "Third Parties"). The Company is not liable for any acts, omissions, or failures of such Vendors, including service disruptions, cancellations, schedule changes, or other operational issues, except where the Company has itself acted negligently or in breach of its own obligations.

Disclaimer of Damages

By using the Company's website or services, you assume all associated risks, including risks related to digital security such as malware, viruses, or data corruption. The Company maintains reasonable technical and organisational safeguards over personal data in accordance with the Personal Data Protection Act 2010, as amended by the Personal Data Protection (Amendment) Act 2024, including mandatory data breach notification procedures.

The Company shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue, profit, or data, arising from:

The use or inability to use the Company's website or services;
Any information, services, software, or materials provided;
Any other matters related to your use of the Company's services.

This applies whether the claim is based on contract, tort, strict liability, or any other legal theory, even if the Company has been advised of the possibility of such damages, save that nothing in this Disclaimer excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under Malaysian law, including the Consumer Protection Act 1999.

Special Notice to Customers

All travel arrangements, including flights, accommodations, and event bookings, are subject to price changes imposed by Vendors, Third Parties, or government authorities after payment or deposit is made. Customers will be notified of any material price change prior to finalisation of their booking, and acknowledge and accept that such adjustments may occur.

All customers are bound by the terms and conditions of the Vendors or Third Parties, including cancellation policies. The Company will take reasonable steps to make such third-party terms available to customers upon request.

Indemnity

You agree to indemnify and hold harmless Che Wan Travel & Tour Sdn. Bhd., its employees, affiliates, and contractors from all claims, losses, damages, fines, liabilities, and legal fees arising from:

Your use of the Company's website or services;
Your breach of this Disclaimer or the Agreement;
Your actions that cause loss, damage, or legal issues, including intellectual property infringement.

Jurisdiction

This Disclaimer is governed by the laws of Malaysia. Any disputes shall fall under the exclusive jurisdiction of the courts of Selangor or the Wilayah Persekutuan Kuala Lumpur, without prejudice to a consumer's right to bring an eligible claim before the Tribunal for Consumer Claims Malaysia or the Small Claims Court.

Severability

If any clause in this Disclaimer is found invalid or unenforceable under applicable law, the remaining clauses shall continue to remain in full force. A replacement clause will be constructed to best reflect the intent of the original clause, to the extent permitted by law.

Concluding the Agreement

This Disclaimer, together with the Company's Service Agreement, Terms & Conditions, Payment Policy, and Privacy Policy, constitutes the entire agreement between the parties and supersedes all prior electronic, oral, or written communications.
